The Australian Federal Government will pay an extra $5.5 million to settle allegations that it knowingly increased the sale of Viagra to a drug which it knew caused men to take erectile dysfunction drugs.
The Federal Attorney General's office has asked for a full refund of the estimated $5.5 million settlement.
The settlement is the first step in a massive probe into the health care system that has been under investigation since a federal health care fraud investigation began in August.
The government also sought to recover $1.3 million from Australian consumers.
Viagra, a generic version of the drug sildenafil, is the most prescribed erectile dysfunction drug in Australia and was purchased by the Federal Government in September. The drug was originally developed to treat erectile dysfunction and is currently manufactured in China and is sold under the brand name Cialis.
The Federal Attorney General’s office has also been investigating whether the sale of Viagra and Cialis was motivated by financial pressures to make a profit, or a deliberate attempt to evade the law, particularly one involving a marketing campaign.
“The Federal Government’s decision to take an extreme profit-making strategy should not be taken lightly,” said Attorney General Mark Milgram.
“We do not believe a profit is a bargain, but the reality is that the pharmaceutical industry is very powerful. And the drug industry is very powerful, and in the United States, we have the potential to see the world’s largest drug companies operating together in an attempt to get drugs, and that is in large part a marketing strategy for the pharmaceutical industry.”
The Federal Attorney General’s office said the investigation into the scheme “demonstrates what the drug industry is capable of” and is “well placed to investigate”.
A spokesperson for the Pharmaceutical Manufacturers Association (PMA) said: “The Australian Federal Government will continue to investigate and prosecute any fraudulent activities that may be associated with the marketing of Viagra and Cialis and will investigate all possible forms of fraud.”
The Department of Health’s drug regulator will issue a public warning to any health-care professionals who are being impacted by the scheme.
The Department’s medical watchdog, the Australian Competition and Consumer Commission, will also be monitoring the scheme to ensure that the drug is being used in a manner that is “well suited to a health care professional”.
